The Arkansas truck accident attorneys at the Levar Law Injury & Accident Lawyers watched with interest this spring as our state legislators approved a liability protection bill that prevents truckers from having to agree to contractual terms requiring them to take responsibility for all accidents regardless of the circumstances.
Arkansas became the 42nd state in the United States to pass such legislation, according to the freight industry news outlet Transport Topics. Its coverage goes on to recall how Arkansas truckers attempted once before (in 2013) to secure such legal liability protection. That year, their issue was trumped by other legislative business.
Although passage of the bill could have several repercussions, one of the results will be the need to determine on a case-by-case basis exactly the circumstances surrounding an accident involving a truck, and exactly which drivers or parties should be held legally and financially liable after a truck accident. Such investigations could spur an uptick in truck accident lawsuits in Arkansas, particularly in regions of the state that are highly traveled by commercial trucks.
At the Levar Law Injury & Accident Lawyers, we have handled truck accident cases in which drivers, trucking companies and cargo companies have all borne some degree of accident or injury liability.
